I'm pretty sure the reference was that Tommy Chong was put in jail largely as symbolism for the War on Drugs. He was released shortly after and the point was more for the public to see that even Tommy Chong was getting arrested for smoking weed.
Similarly, the people that get in trouble for downloading music are sued mostly to cause fear amongst downloaders.

I have very mixed feelings about it. On one hand, Im concerned that the rampant downloading of my copyright-protected material over the Internet is severely eating into my album sales and having a decidedly adverse effect on my career. On the other hand, I can get all the Metallica songs I want for FREE! WOW!!!!!

Boy, I've listened to this song too many times to count already in the last hour. If the rest of the album is even close to this good, we're in for the best album of his career.
I really can't wait to have the instrumental version of this on the DualDisc. I think this is one of the many originals in which the music is even better than the lyrics! I especially love the little bit of the tune that plays right after the first "Don't download this song" in the chorus. I can't stop humming it!
